Terms of Service

1. Agreement

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and services operated by r3wind ("we," "us," or "our") under the name r3wind (collectively, the "Service").

By accessing or using the Service, creating or joining an event, or purchasing a paid feature, you agree to these Terms. If you do not agree, do not use the Service.

Your use of the Service is also governed by our Privacy Policy and any additional policies we may publish from time to time.

2. The Service

r3wind lets event hosts create shared photo rolls — limited-shot, disposable-camera-style photo experiences — and invite guests via QR code or link. Guests may participate without creating a traditional account. Photos may be hidden until an event ends, depending on event settings.

We may change, suspend, discontinue, or update any part of the Service at any time. Features described on our website or marketing materials (including AI recap or similar features) may be labeled as upcoming, experimental, or beta and are not guaranteed to be available or error-free.

AI-generated outputs may contain inaccuracies, omissions, or unexpected results and are provided for entertainment or convenience purposes only.

3. Eligibility

You must be at least 13 years old (or the minimum age required in your country) to use the Service. If you are under the age of majority in your jurisdiction, you represent that you have permission from a parent or legal guardian.

You may not use the Service if you are prohibited from doing so under applicable law, including export control or sanctions laws, or if we have previously terminated or restricted your access.

4. Access and Participation

r3wind is designed to support lightweight participation without requiring traditional account registration.

Hosts and guests may access events using temporary access credentials, links, QR codes, local device storage, or similar session-based mechanisms. Access continuity may depend on the device or browser retaining those credentials.

Event links and QR codes should be treated like private access credentials and shared only with intended participants.

You are responsible for maintaining control of devices, links, QR codes, or access credentials associated with your events. Anyone with access to an event link, QR code, shared device, or stored browser session may be able to access related event content.

We are not responsible for loss of access caused by deletion of browser or device data, clearing local storage, loss of device access, expired session credentials, or sharing event links or devices with others.

You are responsible for obtaining appropriate consent from event attendees before collecting, uploading, sharing, or displaying their photos or likenesses, and for complying with laws applicable to your event, including privacy, publicity, employment, and recording laws.

5. Paid Features and Pricing

r3wind offers a free hosting tier and paid hosting tiers. The free tier lets you create an event for up to five (5) participants at no charge — no payment is required and you are not limited to a single free event.

Paid tiers support a higher participant limit and additional features described on our pricing page. When you select a paid tier, you pay a single one-time fee for that event at the time you create it. The participant limit and total price are shown on the create-event flow before you are sent to checkout.

Guest participation is always free. Guests are never asked to pay to join an event, use the camera, or view the in-app gallery.

There is no subscription or recurring billing. Each paid fee applies only to the event you are creating.

Checkout is handled by Stripe Checkout, a hosted payment page operated by Stripe, Inc. and its affiliates ("Stripe"). You enter payment details on Stripe's pages, not on ours. By completing a purchase, you also agree to Stripe's applicable terms and privacy policy. We do not receive or store full payment card numbers on our servers.

An event on a paid tier is not fully activated for guest access until your payment is successfully completed and confirmed by us (including via Stripe webhooks). If you abandon checkout, the event may remain unpaid and guests may not be able to join until payment is completed.

Prices may exclude applicable taxes, duties, or governmental charges unless stated otherwise.

All fees are charged at the time of purchase and are non-refundable except where required by law or explicitly stated in our refund policy below.

We may change pricing, tier limits, or included features at any time. Changes apply only to new events created after the updated pricing becomes effective.

6. Refunds

Digital services are generally provisioned immediately after purchase and are therefore generally non-refundable.

If you believe you were charged in error, experienced duplicate billing, or encountered a material technical failure of the Service that prevented reasonable use of a purchased event, contact support@r3wind.click within 14 days of the charge with your event details and transaction information.

We will review refund requests in good faith and may issue refunds where required by law or at our discretion.

Refund requests may be denied where substantial use of the Service has already occurred, including where photos have already been uploaded or shared through an event.

7. Your Content

You retain ownership of photos and other content you upload ("User Content").

By uploading User Content, you grant r3wind a worldwide, non-exclusive, royalty-free license to host, store, reproduce, process, display, distribute, and create technical modifications of that content solely for the purpose of operating, securing, improving, and providing the Service, including making content available to event participants according to event settings selected by the host.

You represent and warrant that you have the rights and permissions necessary to upload and share the User Content; the User Content does not violate applicable law or these Terms; and the User Content does not infringe the rights of others.

Hosts control event settings, including visibility and retention where available.

We reserve the right, but are not obligated, to investigate, moderate, remove, restrict, or disable access to User Content that we reasonably believe violates these Terms, applicable law, the rights or safety of others, or the integrity of the Service.

We may retain backup or archived copies of User Content for a limited period reasonably necessary for security, fraud prevention, legal compliance, dispute resolution, or disaster recovery purposes.

Deletion of events or User Content may not immediately remove all backup or cached copies.

If you believe content or behavior on the Service violates these Terms or applicable law, contact support@r3wind.click.

8. Acceptable Use

You agree not to:

  • upload illegal, exploitative, harassing, hateful, or non-consensual intimate imagery;
  • infringe intellectual property, privacy, publicity, or other rights;
  • attempt to bypass shot limits, event restrictions, access controls, or security measures;
  • use bots, scrapers, automated systems, or unauthorized scripts except as expressly permitted by us;
  • reverse engineer, interfere with, disrupt, or compromise the Service;
  • distribute spam, malware, phishing content, or fraudulent material;
  • use the Service in a way that could harm other users or the Service itself.

We reserve the right to investigate suspected violations of these Terms.

9. Intellectual Property

The Service, including its software, branding, design, interfaces, logos, and related materials, is owned by r3wind or its licensors and is protected by intellectual property laws.

Except for the limited rights expressly granted in these Terms, no rights or licenses are granted to you.

10. Copyright Complaints

If you believe content on the Service infringes your intellectual property rights, contact support@r3wind.click with sufficient details for us to investigate, including:

  • identification of the allegedly infringing content;
  • identification of the claimed rights; and
  • your contact information.

We may remove or restrict allegedly infringing material at our discretion.

11. Third-Party Services

The Service relies on third-party providers such as Stripe, hosting providers, cloud storage services, analytics tools, and anti-abuse systems.

Your use of third-party services may be subject to their separate terms and privacy policies. We are not responsible for third-party services outside our reasonable control.

12. Force Majeure

We will not be liable for any delay or failure to perform resulting from causes outside our reasonable control, including natural disasters, pandemics, war, terrorism, riots, embargoes, acts of civil or military authority, fire, floods, accidents, strikes, power outages, or failures of third-party internet service providers.

13. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, r3wind DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RELIABILITY.

We do not guarantee uninterrupted access to the Service, permanent storage or preservation of photos or event content, compatibility with every device or browser, or that the Service will always be secure or error-free.

14. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, r3wind AND ITS AFFILIATES, OFFICERS, EMPLOYEES, CONTRACTORS, LICENSORS, AND SUPPLIERS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, GOODWILL, PHOTOS, OR EVENT CONTENT, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

  • (A) the amount you paid us for the applicable event giving rise to the claim; or
  • (B) USD $100.

OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE WILL NOT EXCEED THE GREATER OF:

Some jurisdictions do not allow certain exclusions or limitations of liability. In those jurisdictions, liability is limited to the fullest extent permitted by law.

15. Indemnity

You agree to defend, indemnify, and hold harmless r3wind and its affiliates, officers, employees, contractors, and licensors from claims, liabilities, damages, losses, and expenses arising from:

  • your User Content;
  • your events;
  • your misuse of the Service; or
  • your violation of these Terms or applicable law,

except to the extent caused by our gross negligence or willful misconduct.

16. Termination

You may stop using the Service at any time.

We may suspend, restrict, or terminate your access to the Service if we reasonably believe you violated these Terms, created risk or harm to others, exposed us to legal liability, or if required by law.

Provisions that by their nature should survive termination — including licenses, disclaimers, limitations of liability, indemnities, and dispute-related provisions — will survive termination.

17. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict-of-law principles.

You and r3wind agree that disputes arising from these Terms or the Service will be resolved in courts located in Delaware, United States, except where applicable law provides otherwise.

18. Changes to These Terms

We may update these Terms from time to time.

We will post the revised version on this page and update the "Last updated" date. Material changes may also be communicated through website notices or other reasonable means where appropriate.

Your continued use of the Service after updated Terms become effective constitutes acceptance of the revised Terms.
